Terms of Service for Manhwa AI

1. Introduction

Welcome to Manhwa AI, owned and operated by Kawaii, Inc., an AI-powered image & text generation application. These Terms of Service ("ToS") are a legal contract between you, the user, and Manhwa AI ("we", "us", or "our"), governing your use of the Manhwa AI application and services.

2. Acceptance of Terms

By creating an account, downloading, installing, or using Manhwa AI, you agree to be bound by these ToS. If you do not agree to all terms and conditions, do not use Manhwa AI.

3. Eligibility

You must be at least 13 years of age to use Manhwa AI. Users under 18 must have permission from a parent or legal guardian.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Providing false contact information of any kind may result in the termination of your account.

5. Use of the Service

Manhwa AI allows you to generate images based on textual inputs using AI technology. You agree to use Manhwa AI only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of Manhwa AI. The Service is provided for personal, non-commercial use only.

6. Content and Conduct

You are solely responsible for the text inputs you use to generate images and any content you create, share, or display on or through Manhwa AI.
You must not use Manhwa AI to create, share, or display:
  • Illegal or unlawful content.
  • Infringing content that violates intellectual property rights.
  • Content that is defamatory, obscene, pornographic, offensive, hateful, or promotes violence or harm.
  • Content that violates privacy or publicity rights.
Manhwa AI reserves the right, but not the obligation, to review and remove or disable access to content that we determine, in our sole discretion, violates these ToS.

7. Intellectual Property Rights

For any images/content you generate using our services, you retain full ownership to the maximum extent permitted by law. However, there are a few caveats:

  • Your ownership rights are limited by the terms of this Agreement.
  • The rights of any third parties may also affect your ownership.

8. License Grant to Manhwa AI

By using the Services, you grant to Manhwa AI, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute text prompts/images you input into the services, or images produced by the service at your direction. The license granted to Manhwa AI remains in effect even after termination of this Agreement by any party, for any reason.

9. Privacy Policy

Your use of Manhwa AI is also governed by our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy.

10. Limitation of Liability

Manhwa AI and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.

11. Changes to Terms

Manhwa AI reserves the right to modify these ToS at any time. We will provide notice of any significant changes by posting the new ToS on the service.

12. Termination

Manhwa AI may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including breach of these ToS.

13. Governing Law
